Chicagoland Theatre Fund Streaming Terms of Use

Chicagoland Theatre Fund provides a streaming service (“Chicagoland Theatre Fund Streaming” or “CTFS”) that allows members to access entertainment content (“CTFS content”) over the Internet on certain Internet-connected TVs, computers, and other devices (“CTFS-ready devices”).

The CTFS service is provided by Chicagoland Theatre Fund LLC. By using our service, you agree to these Terms of Use. As used in these Terms of Use, “CTFS service”, “our service”, or “the service” refers to the personalized service provided by CTFS for discovering and accessing CTFS content, including all features, functionalities, recommendations, reviews, websites, and user interfaces, as well as all associated content and software. “You” refers to the member who created the CTFS account and whose payment method is charged.

YOU AGREE TO THE ARBITRATION AGREEMENT AND CLASS ACTION WAIVER DESCRIBED IN SECTION 7 TO RESOLVE ANY DISPUTES WITH CTFS (EXCEPT FOR MATTERS THAT MAY BE TAKEN TO SMALL CLAIMS COURT).

CTFS Account

1.1 Your CTFS account will continue until terminated. To use the CTFS service, you must have internet access, a CTFS-ready device, and provide one or more valid Payment Methods.

1.2 We may offer various membership plans, including those offered in conjunction with third-party services. These third parties are solely responsible for their products and services. Details of your plan can be found under “Account” on CTFS.com.

Promotional Offers

We may offer promotional plans or memberships (“Offers”). Eligibility for these Offers is determined solely by CTFS. We may revoke or withhold Offers at our discretion. Eligibility requirements and limitations will be disclosed at sign-up or in related communications.

Billing and Cancellation

3.1 Payment Methods. You authorize us to charge any associated Payment Method if the primary one is declined. Some Payment Methods may involve additional fees; please check with your provider.

3.2 No Refunds. All payments are nonrefundable. We may, at our sole discretion, offer credits or refunds, but doing so does not entitle you to future consideration.

CTFS Service Use

4.1 You must be at least 18 to use CTFS. Minors may use it under parental supervision via the parent or guardian’s account.

4.2 CTFS content is for personal, non-commercial use only. Sharing outside your household is not allowed without CTFS’s written consent. You may stream content on one device at a time.

4.3 Access to content may vary by geography. Simultaneous streaming is limited to one device.

4.4 You may not:

Record, reproduce, download, repost, or publicly share CTFS content;
Circumvent content protections;
Use automated systems (e.g., bots, scrapers);
Reverse-engineer or tamper with CTFS software;
Upload harmful content or software.

IMPORTANT: Screen recording, screen capturing, reposting, redistributing, or rebroadcasting any portion of CTFS content is strictly prohibited.

Any such unauthorized use constitutes a direct violation of federal copyright law (17 U.S. Code § 501) and may result in immediate account termination, civil liability, and/or criminal prosecution. CTFS will pursue all available legal remedies, including injunctive relief, damages, and attorneys’ fees, against any individual or entity found responsible for unauthorized distribution or leaks of CTFS content.

4.5 Video quality depends on your device and internet connection. CTFS makes no guarantees regarding resolution, latency, or streaming consistency.

4.6 CTFS software is licensed to you for streaming use only. Updates may be installed automatically.

4.7 CTFS is not responsible for third-party device performance or compatibility.

Passwords & Account Access

You are responsible for activity on your account. Do not share your password or Payment Method details. CTFS may suspend or terminate accounts to protect against fraud or unauthorized access.

Data Privacy & Security

6.1 Information We Collect

We collect your personal information (e.g., name, contact info, billing address, and payment data) to deliver and manage the CTFS service.

How We Protect Your Data

We use secure industry-standard safeguards, including restricted access controls.

Although we strive to protect your data, no system is entirely secure. In the event of a data breach involving personal information, CTFS will promptly notify affected users in compliance with applicable privacy laws.

6.3 Information Sharing

We do not sell your personal information. We may share it with:

Payment processors and IT service providers under strict confidentiality,
Legal authorities when required,
Business successors (e.g., in a merger or acquisition).

6.4 Your Responsibility

You are responsible for keeping your account secure. Do not share your credentials or payment details. CTFS is not liable for data accessed through negligence or misuse of your account.

Disclaimers and Limitations of Liability

7.1 The CTFS service and all associated software and content are provided “as is” and “as available.” CTFS makes no warranties of uninterrupted or error-free use.

7.2 To the maximum extent allowed by law, CTFS and its affiliates are not liable for indirect, incidental, or consequential damages, including loss of personal data or content access.

7.3 These Terms do not limit any rights granted to you under mandatory consumer protection laws.

Miscellaneous

8.1 Governing Law. These Terms are governed by the laws of the State of Illinois.

8.2 Unsolicited Materials. We do not accept unsolicited ideas and are not responsible for content similarities.

8.3 Feedback. CTFS may use any feedback you submit without compensation or restriction.

8.5 Severability. If any provision is invalid, the remaining provisions remain enforceable.

8.6 Changes to Terms. We may revise these Terms at any time. For active users, changes will be effective 30 days after posting.
